Eagle and Fergus — and his other co-workers — face greater penalties in the coming months after a federal tribunal ordered a $3 million fine on two human smuggling cases.
The largest of the six bogus human smuggling cases involving Eagle and Fergus was opened in 2002, when they allegedly traded 10,000 eggs to buyers in a Malaysian brothel at the height of the financial crisis.
On Thursday, RCMP responded to an inquiry regarding the case, announcing, in a news release, that it had found evidence of trafficking and smuggling materials in the brothels.
Anti-trafficking officials in Malaysia say the scheme is rife with fraud and abuse and that the government has taken no action.
Under previous Canadian governments and the RCMP, trafficking was banned in Canada.
In the case of Eagle, the government says it was aware of his smuggling to Canada, but removed his name from the register.
The RCMP said it also acknowledged placing the brothel under complaints process.
“The government has determined that it is in compliance with the Dangerous Drugs and Substances Act (DSA) and is working closely with the Department of Justice to ensure that offences involving human smuggling and marijuana are appropriately dealt with,” the Canadian Strategy for Anti-Trafficking said in a release Wednesday.
Eagle’s case will be heard in the Criminal Court of Canada in Vancouver Wednesday, Aug. 2, as part of a multi-million-dollar criminal prosecution against the two men charged with trafficking and offering $7 million in stolen property, including an 800-kilometre bus line.

The case has been referred to the Criminal Court in Canada and the Criminal Code of Canada.
The Crown says it plans to file a joint statement with the Justice Ministry, which will tell it, without giving further details, whether the RCMP has taken action against Eagle or Fergus.
“The Crown will submit an emergency response plan at the request of the RCMP. The earlier case was handled by the RCMP’s Criminal Investigations Unit,” the release said.
“The RCMP will perform its investigative first and, using its civil forensics expertise, will make conclusions and take action against the defendants. Criminal authorities will be referred to the Canadian Criminal Court.”
The RCMP said it carries out an extensive monitoring of the operation, now underway — and stopped in Malaysia.
The RCMP said the stop in Malaysia is not illegal, and says it has conducted surveillance over the past 12 months.
Eagle and Fergus did not respond to requests for comment.
Eagle and Fergus were arrested on June 20 following more than three years of deals between them.
Eagle and Fergus alleged they were working as a bit of a freight delivery company that began to pay for their transport, and trafficking drugs.

A week later, Eagle told police that he was coming from New Zealand to meet another trafficking victim.
The alleged victim was in Australia, where she had been receiving methamphetamines, Naloxone and Oxycodone.
Eagle and Fergus were then involved in a human trafficking case involving compensation payments she received from flying addresses in Canada.
Eagle and Fergus were also accused of selling methamphetamines and selling cocaine to three other men from Singapore.
Eagle, who is now in prison, was also charged with two counts of trafficking in an illegal firearm for his alleged role in the smuggling of pills to Singapore and a pair of silencers for the shipping of heroin.
Court documents say Eagle and Fergus were not arrested for the smuggling of drugs. In fact, they are both being held at Guantanamo Bay in Cuba awaiting trial on charges of trafficking in drugs.
